This presentation looks at the prohibited transaction rules of ERISA and the Code. We will look at who’s covered, what’s prohibited, and what to do about it when it happens. More than just the rules, this session will look at many practical (and sometimes surprising) situations when a prohibited transaction can arise.
S. Darrin Watson, J.D., APM, received his bachelor's degree in accounting from Brigham Young University, and his J.D. from UCLA Law School. He has been involved with qualified plans since 1977 and had his first case involving controlled groups shortly thereafter. He lectures frequently for the American Society of Pension Professionals and Actuaries (ASPPA) and was named recipient of ASPPA's 2006 Educator's Award for his dedication to education for the next generation of retirement plan experts and his continuous support of others. Derrin is a regular presenter at various SunGard Relius Education programs. Derrin is actively involved in authoring The Pension Library, a SunGard technical resource publication, and has authored several articles for the Journal of Pension Benefits, for ASPPA publications, and is the author of Who's the Employer, a detailed analysis of employee and employer issues (leased employees, controlled groups, etc.) that affect qualified plans.
