Controlled groups, affiliated service groups, management function groups, and three different sets of attribution rules.  Identifying related (and unrelated) employers can be challenging even for experienced practitioners, yet much rests on the proper identification of the employer for ERISA purposes.  This presentation will provide an overview of the controlled group and affiliated service group rules along with the consequences associated with having related employers.  The focus will be on helping practitioners identify situations in which a related employer situation may exist.

 

 

DAVID SCHULTZ, J.D.

David Schultz is an attorney and educator with FIS’ Relius in Atlanta, Georgia. David’s over 18 years of experience in the industry includes service as an ERISA attorney, the manager of a TPA and recordkeeper, an investment advisor focused on qualified plans, and a fiduciary consultant. David is the current Chair for the Administrative Relations Subcommittee of the American Society for Pension Professionals and Actuaries’ (ASPPA) Government Affairs Committee.

 

David earned a BS with a major in Finance from the University of Florida and his Juris Doctor from Georgia State University. He is a member of the Georgia Bar Association.
