    While we don't delight in other employer's misfortune, those schadenfreude moments involving employer and employee missteps allow us to learn from the mistakes and teachable moments experienced by other employers.  This session will identify and explore the top 10 mistakes made by employers, including failing to document performance issues and failing to stay up-to-date on local and state law developments (such as new paid sick leave laws and harassment policy/training requirements) and the solutions with each of the 10 mistakes to keep your legal spend under control by being proactive.

    About Nonnie Shivers, Attorney at Law

    Nonnie partners with employers and managers in three primary ways: litigation avoidance through proactive counseling and training; investigations and resolutions when pre-litigation concerns arise; and litigating legally complex and factually challenging cases to defend employer’s actions.  

    Nonnie advises and counsels private and public employers in all aspects of employment law, including an emphasis on complex but proactive compliance projects, such as 50-state compliant wage deductions and lawful parental leave programs. Nonnie regularly partners with clients to plan and implement reductions in force, severance plans and agreements, and pre-litigation disciplinary matters. Nonnie regularly conducts high-level internal investigations for clients, including at the executive level and within key departments, and assists in identifying and resolving potential areas of liability and exposure in a proactive but practical way. Nonnie’s unique practice also includes providing employment advice for employers doing business within the Navajo Nation's territorial jurisdiction and other tribal lands, including cultural and employment law training on unique tribal code requirements.  

    Nonnie has successfully defended employers against allegations of discrimination, sexual harassment and wrongful termination in state and federal court, as well as administrative forums. Nonnie has handled hundreds of charges with the U.S. Equal Employment Opportunity Commission and the Arizona Civil Rights Division, as well as claims and appeals filed with the Industrial Commission of Arizona. Nonnie has also litigated whistleblower claims against air carriers under AIR 21 and handled investigations and enforcement actions with numerous other federal agencies, including the U.S. Department of Labor and other employers under SOX.

    Nonnie regularly speaks and trains on current and emerging employment law topics, including recent presentations to industry and trade groups on civility in the #MeToo era, gay, lesbian, bisexual and transgender workplace issues, avoidance of retaliation claims, and political expression in the workplace. Nonnie’s advanced degree in education and years of experience as an instructor and student affairs professional at Arizona State University help make her training sessions and presentations simultaneously educational and entertaining. Nonnie has also published several scholarly articles focused on employment law, including a book chapter on the impact of reasonable workplace accommodations for employees with disabilities on employers and employees’ expectations of privacy for off-duty conduct.

    Nonnie has received numerous accolades from clients and legal professionals for her dedicated client focus and problem-solving abilities. Southwest Super Lawyers named Nonnie a Rising Star in 2012-2014 and a Super Lawyer from 2015 through today. Nonnie also obtained the recognition of the legal community by receiving an AV Preeminent Rating by Martindale-Hubbell beginning in 2014 through today.  Chambers USA first ranked Nonnie as a Leading Individual in 2015 and Best Lawyers added Nonnie to its list of recognized practitioners in 2016.  Prior to joining the firm, Ms. Shivers served as a law clerk to the Honorable Patricia K. Norris on the Arizona Court of Appeals.

    FREE Basics of ERISA

    Designing, administering, and at times correcting a retirement plan is no easy task.  It is essential for HR and Benefits professionals to be well informed about the basic requirements of ERISA, including their own fiduciary responsibilities with respect to hiring and monitoring plan service providers, and how to avoid common plan problems or fix them if they occur.  Knowing ERISA’s standards and common issues helps your organization get the service it needs and protects it from costly penalties and time-consuming problems. The Phoenix Chapter of Western Pension and Benefits Council is pleased to invite you to join us for an informative workshop on ERISA Basics on March 28, 2019, from 8:00-10:00am.

    Session 1 – Hiring and Monitoring Service Providers for your Retirement Plan

    ERISA requires that plan fiduciaries administer plans according to the law and the plan terms, but this can be daunting for anyone.  To help, you will at various times need service providers who are experts in their field to help you, including for example a recordkeeper, third party administrator, auditor, financial advisor, or ERISA attorney.  But how do you know which to hire, and what your ongoing responsibilities are after you’ve hired them?  Laura Bartlett, Senior Vice President of Institutional Wealth at BOK Financial, will lead us through a discussion of how you can choose your plan’s service providers and what you need to do once they are engaged. 

    Session 2 – Common Plan Problems (And How to Avoid Them)

    Even with qualified and competent service providers, it can be a challenge to administer a plan perfectly.  This session, presented by J.K. Nowiejski of Nova 401(k) Associates, identifies some common plan errors and explains how to avoid them so you can have additional time and attention for the more difficult issues that will inevitably arise in any plan.  It will also address what you can do if (despite your best efforts) you run into these common problems in your plan.

    Eric Mcelvenny

    Eric is an amputee endurance athlete living in Pittsburgh, Pennsylvania.  He earned a mechanical engineering degree from the United States Naval Academy in 2006 while preparing for his service as a Marine Corps Infantry Officer.  Eric deployed three times as a Marine and on his final tour, an incredible experience in Afghanistan, was wounded after stepping on an IED.  Eric suffered the amputation of his right leg below the knee, a life-changing opportunity that began his next journey. 

    Faced with physical challenge and an uncertain future, Eric made a promise to himself to run an Ironman Triathlon.  On his journey from the hospital bed in southern California to the finish line in Kona Hawaii, he realized that the challenge and adversity he was up against and the techniques he used to reach the finish line could be used against the challenges we all entertain.  When not training, racing and delivering inspiration, Eric can be found with his wife Rachel and three children in Pittsburgh, Pennsylvania.

Refund Policy

A refund is provided for a meeting reservation that is cancelled more than 72 hours before the reservation deadline for the event.  Therefore if the event is scheduled for 11:30am on January 21st you have until 11:30am on January 18th to cancel your reservation and receive a refund.  All paid events are transferable to another attendee for the same event.
